In regard to the staffing pattern of Commercial Cadre the suggestion to keep ticket checking cadre away from the proposed  merger of commercial cadre of coaching  clerks and ECRC is acceptable to this Union and appreciated.

 

In regard to the proposal of merger of Coaching Clerks and ECRC cadre the staffing pattern proposed by Federation has also been agreed upon subjected to the conditions laid down in para (i) of your draft proposal prepared by the Federation.

Sub: Draft Documents submitted by NRMU(CR/KR) during AIRF

safety seminar of TMD Staff on 2.4.2018 at NDLS.

 

 

At the outset this union extents its hearty congratulations and compliment the decision taken by AIRF to hold an All India  Safety Seminar of TMD department on 2.4.2018 at NDLS. This timely initiative of federation has well appreciated by the TMD staff of C.Rly and they expressed their gratitude for providing them an opportunity to participate in the event.

 

It is a matter to reckon that in consequent to the formation of TMD department in Civil Engineering stream of Indian Railways, its importance has been spread wide along with mechanization and automation processing in the track laying and maintenance works with utilization of different type of modern track machines and specialized skilled labour force. The importance of this department is going to break the boundary of its present structure and will play a crucial role in infrastructural development of track length and its upkeep. More and more sophisticated machines are likely to be introduced in the near future and the staff strength is invariably needs to cross its leaps and bounds. Hence the present predominance of this department in the safety category will have a multi faceted lift in the coming years.

 

Few important points related with safety aspects pertaining to TMD department and staff matters are appended below for your kind perusal and deliberation in the proposed safety seminar and thereafter for representation at appropriate forum for prompt attention and positive disposal.

 

SAFETY CONCERNS:

 

  1. Filling up of Vacancies & Non creation of additional Posts:The present vacancy position of staff in this department is too high. The sanctioned strength approved on the availability of machines decades back have not been reviewed till now. In C.Rly against the sanctioned strength of 1008 posts only 648

 

Men are in position leaving 360 posts vacant to the tune of about 38%. Apart from that, additional machines have been introduced widely for which creation of staff has not been done.

Therefore it is an alarming situation whereby the lower rank staff are compelled to discharge responsibilities of higher posts in high and sophisticated machines such as UNIMAT, UTV and Tamping Machines without any benefits, perform over hours of duty even forgoing their legitimate daily and weekly rest periods, unintentionally forced to adopt unsafe working practices and indulge in short cut methods and invites disastrous results. The peculiarity of Mumbai division of C.Rly where the block corridor is only available during night, additional staff strength to the tune of 50% of the machine attached staff is needed to deploy for maintenance of the machines.They are also deprived of their family and social obligations as very often they are denied of their leave and rests. Hence to upkeep the safe work culture and to maintain the safety standard intact in working of machines thevacancies of the staff in different cadres of TMD department needs to be filled and additional manpower must be allocated with immediate effect.

 

  1. Amendments required in G&SR. Various provisions in chapter 4 of G&SR such as 4.12, 4.25 (1), 4.45, 4.46, 4.47 (1&2), 4.65 etc needs a relook which pertains to prohibition of push back working of UTV machines  on Main lines, provision of Guard while working of UTV and movement of camping coaches with provision of breaking apparatus, hand break, side lamp and tail lamp and exchange of numbered TTM permits for working in the section and dispatch of multiple machines in the section on single authority respectively. To ensure safety effectively, pilots also needs to be given as is being provided to tower wagon working during movements in block periods. Provision of imposing Caution Orders in the adjacent lines of the block with a speed restriction of 30 kmph must also to be mandated.

 

  1. Regulate deployment of staff to minimum night shifts in a week & Implementation of 21/07 days roster. The present pattern of utilization of staff for continuous  night shifts at a stretch to even 26 days in a month is creating fatigue and other stress related problems to them. This further propel the staff for error of judgement in their respective duties that causes irreparable damage and threat to the safe working environment. Their absence from their residence and family members for working at far flung remote areas for prolonged period along with this continuous night shifts is therefore detrimental to the interest of safety and is very hazardous. Therefore the night shift of the staff must be mandated to a maximum of 2 nights in a week and accordingly the rosters of their duties must be amended.  

 

Despite of repeated reminders from the Railway Board, C.Rly zonal administration are showing apathy towards implementation of  21/07 days roster citing the high volume of vacancies existing in the zone. This itself shows the callousness of the administration that have done nothing to fill the vacancies and have not prioritized the need of creation of posts adequately to meet the requirement of staff to operate additional machines introduced. The requirement of

staff strength for the purpose of RG/LR and Trainee Reserve posts are also not considered till now. The onus of their lapses are being fallen upon the staff which deprived their legitimate privilege of 21/07 days roster which would have given tremendous relief to the staff working at remote areas. It is therefore imminent to introduce this roster which has already implemented in 8 zones till now uni-formally at all remaining zones including C.Rly with immediate ef

 

  1. Inadequate Track Machine Sidings and Non availability of Basic amenities where it available: Track Machine sidings are too inadequate in comparison to the number of machines available in all divisions especially in Mumbai division of C.Rly.  Necessary plan or road map has not been prepared by the administration for additional machine sidings against the additional expected machines invariably to be introduced in the coming days. Basic requirement of electric lights, pathways, water and other staff amenities are un available in most of the sidings. Rest facilities required for the staff at these sidings are also unseen. It is therefore necessary to create machine sidings in tandem with the availability of the machines in all divisions ensuring all facility for their maintenance  and comfort of the staff.

 

STAFF MATTERS  

  1. Rest room facility of TMD staff must be upgraded on par with Running room facilities given to the running crew. They may be permitted to avail their rest in running rooms in earmarked beds where rest rooms are unavailable.

 

  1. The duty hours of the staff deputed to work in machines placed at different locations may be counted from their head quarters and they may be provided exclusive transportation facility to reach the locations/sidings to take charge of the machines.

 

  1. In consideration to the strenuousness, element of risk and hazardous involved in their job the R&H allowance may be given to TMD staff.

Sub:       Payment of stipend to Pro-SMs and Tfc. Apprentices

                                                Undergoing initial training at ZRTI BSL.

During a visit of  representatives  of this affiliate to ZRTI /BSL, hundreds of Pro-SMs and Traffic Apprentices undergoing their initial training at ZRTI Bhusaval have  informed that they are paid stipend only in consonance with the comparative pay of erstwhile GP Rs. 2800 (Level – 5) instead of  their entitled Stipend on GP Rs. 4200 (Level – 6).

 

The stipend is being paid in compliance to Rly. Board letter RBE 8/2017 dated 2-2-2017 which indicates varied amount to trainees recruited to different posts in GP Rs.4200/- ranging from Rs. 29,200/- to Rs. 35400/-. Union is of the opinion that the stipend of trainees recruited against posts to identical pay level in pay Matrix should be paid  unformally  irrespective of the period of training stipulated for them.

 

It is matter of fact that the initial pay of SMs have been  revised from GP Rs. 2800 to GP Rs. 4200  further to the implementation of 7th CPC and the designation of ASMs are abolished forthwith. A revised AVC also have been issued accordingly by Railway Board vide its letter dated 16-2-2018. The recruitment Grade of Traffic Apprentice are also  in the GP of  Rs. 4200 and it is learnt that  they are also paid stipend of GP Rs. 2800 (Rs. 29200)  which is not justifiable in any terms.

 

Union hereby urges you to look into this issue and may do the needful for necessary amendment in RB order  to pay the stipend uniformally reckoned with the pay of  GP  Rs. 4200/- (Rs. 35400/-)  which is the initial pay of SMs and Traffic Apprentices as well.

Numerous gatemen of operating department who are deputed to work in the Traffic gates are raising their demand for this allowance as the pattern of duty and responsibility of the traffic gatemen are very much similar and safety oriented.

However, it is being learnt that eligible staff on merit of their educational qualification from medical department are deprived of their opportunity to appear in the examination for selection  through GDCE to different higher graded posts of notified department. This restriction that has imposed is unjustified as many of the staff of medical departments are highly qualified in different streams which requires for filling up of vacancies of different posts outside the medical department.

The process of conducting job analysis has been initiated by the administration and Union has urged the administration to review the adverse report submitted by the JA team  against the interest of the concerned employees. The committed efforts of this Union is continuing to  redress the legitimate demand of the Pointsmen in the line of the stand taken by the Federation for abolition of EI roaster from Railway HOER classification.

In connection with an anomaly relating to Govt. employees drawing less  pay than another Govt. servant  junior to him a consolidated guidelines have been issued by DOPT vide its OM under reference as above for redressal of such cases.

 

This Union hereby urges you to go through the contents of the OM and may kindly do the needful to reiterate this guidelines from the Rly. Board incorporating clarification on the following.

 

Senior Govt. employee  who retained at his original post and not relieved on promotion to assign his post of promotion whereas the junior staff immediately relieved on promotion has got the benefit on his promotional fixation should be extended the benefit of stepping up of pay as the delay of assigning the responsibility of promotional posts by the senior employee would be merely on administration ground and not at the fault of the senior staff who did not relieved  on  his promotion.

 

You are hereby requested to look into this issue and may kindly do the needful to incorporate the corrections in the OM and may reiterate it by the Railway Board.

This has the reference of the judgement proclaimed by the  Hon. High Court of Madras on a case filed by P. Ayyamperuamal V/s Union of India on the subject matter of granting notional increment to the staff who retire from service on 30th June every year.

 

As a matter of fact you might be aware that the Govt. staff who retire on 30th June  every year are at  loss of a deserving increment even after completion of the period of one year after drawing last increment and as they are not considered to be  in service on first of July  they are deprived of their legitimate claim of increment and the consequential pensionary benefit thereon.

 

It is a truth that  this judgement will give great relief and benefit to those staff who retire in the month of June every year if implemented uniformally in Railways. This Union further urges you to raise the issue  at appropriate forum for granting notional increment to all those staff who completed their service more than  six months from their last drawn increment at the time of  their superannuation and may rewarded with other consequential benefits in consideration to their service to the nation.

For example an employee working in Grade Pay Rs. 1800/- the rate is Rs. 96/- whereas previously rate was Rs. 151. It could be seen that there is huge loss of 41% . The matter was taken up with  HQ administration vide HQ PNM Item No. 89/18. No decision was taken at the Zonal level and  the Administration has  referred the matter to Railway Board for clarification on 3-10-2018. Copy of the detailed draft copy of representation of C.Rly. is enclosed herewith for your reference.

Board’s circular No. 09/2017 dated 31-01-2017 and CCM/C&PS, S.C.Rly. issued instruction to all Sr. DCM’s under its jurisdiction, for posting after 80 days training period and certified for “No Field Training”. Further when this Union took up this matter with C.Rly. administration on the same ground vide PNM Item No. 62/18 of GM/PNM C.Rly., he matter has been referred to Railway board for clarifications and instructions. Further this Union is of the view that the Circular No. C.415/E/ Comml. App./P/2014 of 28-02-2018 issued by CCM/C/&PS, S.C.Rly. for training Modules and posting of CA’s after the requisite training at ZRTI’s may please be adopted and Railway Board may kindly be asked to issue to all Zonal Railways for adopting the same module uniformly which is beneficial to both staff and the Railways also.

Complaints of the TTEs are also been registered with this Union in regard to the deficiencies in TTE  Rest house of other zones where the TTEs of C.Rly are reaching after completion of their duty from the  border divisions of C.Rly. It is further learnt that the directives for ensuring improvement of the conditions of TTE Rest house issued  at different occassions by the Railway Board No. (2010/TG-V/CO/3 dated 13-6-2012 and dated 14-11-2013) are still not been complied with by the administration.

Representations are received from staff and officers of Electrical department in regard to various complexities created in the field further to the rationalization process invoked by orders under above reference.

 

The focal point of the issue is that the order which may be issued intended to remove the departmentalism in railways is in gross violation of Electricity Act 2003, Railway Act 1989, AC Traction Manual, Railway (Opening for Public Carriage of Passenger) Rule 2000 and Gazette notification SO 1779 (E) dated 16.5.2016 in regard to inspection norms electrical gadgets and other rolling stock items.

 

The representation (copy enclosed) further elaborate that the quality and standard of statutory inspection and mandatory maintenance of rolling stocks, electrical installations of EMU, MEMU and other high sophisticated train sets, LHB coaches etc..will get compromised as the controlling authority of the Electrical staff who are having requisite expertise and experience are assigned to discharge their duties under the control of  incompetent by virtue of academic qualification, restriction of expertise and non experienced Mechanical branch Officers at higher level.

 

Apart from the non compatibility of professional probity of the staff and officers, it is being alleged that the promotional prospects of electrical supervisors are restricted to bare minimum. It is further told that in absence of a clear line of control the confidence and morale of staff are

diminished and they are scared of victimization in case of major failures due to none of their fault but only due to lack of proper and expertise guidance of Electrical officer above their rank.

 

They have also expressed their reservation and apprehension on the recent order issued in ECoR whereby an ADME have been posted as in charge of TL/AC wing in Puri and Bhuwaneshwar. They have strong reason to think that this could adversely affect the reliability and safety of the system and patter of working in electrical department which may in turn bring undesirable consequential effects to the safety of passengers and the staff working in high voltage during maintenance because of the shift of technical control of their supervisors and officer from Electrical to Mechanical department.

 

In the backdrop of the above federation is hereby requested to persuade the board to review their decision and restore the original system of cadre management in electrical department for benefit of staff, passengers and assets of the railways.

You might be aware that an Expert Committee of renowned doctors including 6 Ophthalmologists were constituted  in February 2015 for revision of IRMM in consonance with the changed time and upgradation of medical treatment facility presently available in the medical field. It is being learnt that the committee has submitted its report on 30-11-2018 to the concerned Directorate of Railway Board.

 

This is to apprise you that thousands of newly recruited youths who undergoes medical examination prior to their posting in Railways in various posts are being deprived of their employment due to declaration of unfit on Eyesight para meters. They are declared  unfit as the medical authorities still follows the para meter prescribed in the age old medical manual which needs revision. Thus it is found that the required number  of people  are not inducted to Railways despite of their meritorious performance in written test and other physical fitness standardized for them.

 

Union therefore hereby urges you to look into the matter and may do the needful to persuade the concerned directorate to get the report submitted by the Expert Committee approved at the earliest possible.

This is to apprise you that vide OM of Ministry of Health & Family Welfare  referred as above a CGHS beneficiaries can get admission in any CGHS empanelled hospital without any prior permission. On reference of certain cases whereby few  hospitals denied admission or insisted referral memo even in emergency,  the Ministry of Health & Family Welfare have given clarification that “refusal to provide treatment to bonafied CGHS beneficiaries in emergency cases without valid ground would attract  dis-qualification and empanelled hospitals will not  refuse admission or demand a advance payment from the beneficiaries or his family members”.

 

Further to the above,  a  Judgement of the Hon’ble Supreme Court of India in the WP filed under reference No. 2 have given detailed guidelines in regard to the mandatory facilities to be provided to the serving Govt. employee as well as pensioners to avail treatment facility at any hospital of his choice on emergency and the medical expenditure incurred to patient needs to be reimbursed in  full.

 

This Union hereby request you to peruse the copy of the judgment enclosed  herewith and may do the needful to persuade Railway board to issue necessary guidelines in tune to the essence of the judgement issued by the Apex Court in the above subject matter.
